INTRODUCTION: A Thematic Guide to Documents on the Human Rights of Women is
the first volume in a new series: The Raoul Wallenberg Institute Human Rights
Guides. As the term `guide' implies, the series will facilitate orientation in
international human rights standards by presenting the content of substantive
standards in a systematic way. The Guides map out the entire range of human
rights and fundamental freedoms as they relate to specific categories of
beneficiaries. Future volumes will be devoted to children, minorities,
indigenous peoples, detainees, migrants, and so on. Volumes are also planned
to deal with health, information, and humanitarian relief, in which the
category of beneficiary is open ended. In all such areas, those who are
professionally involved in human rights activities need guidance to
substantive standards, which are neither widely known nor readily accessible.
This first volume establishes the structure to be followed by future Guides.
Part 1 groups the relevant provisions from different instruments according to
specific rights and freedoms. Part 2 supplies a chronological list of all the
instruments that have been excerpted in Part 1, enabling the user to locate
the entire document if wished. Part 3 contains an extensive index of all
relevant provisions.

INTRODUCTION: This work brings together as one volume a wide range of
material on women and law from different geographical regions and fields of
study, including gender studies, sociology, law and human rights. It quotes
leading cases such as 'Unity Dow' from Botswana, 'Bi Hawa Mohamed' from
Tanzania and 'Magaya', from Zimbabwe; and excerpts from the writings of
leading scholars in the field e.g. Sylvia Tamale, Fareda Banda, Florence
Butegwa and Takyiwaa Manuh. It cites the constitutions and statute laws
pertaining to the position of women in various African countries; reports by
government commissions, international NGOs and human rights conventions. The
book is organised around specific areas of law which impinge upon women:
family law; property ownership, including access to land and inheritance
systems; reproductive rights; sexual and domestic violence; employment
discrimination; and the participation of women in politics. Overall the
authors intend to promote the idea that although women and law is a massive
subject in Africa, and there are many different cultural and legal contexts
and approaches to the debate, there are common threads which relate to the
majority of women across the continent. They show that it is therefore
legitimate and necessary to focus on the big picture rather than take aspects
of the debate in isolation; and identify major concerns to be taken forward at
various levels. Cynthia Grant Bowman is Professor of Law at Northwestern
University School of Law in Chicago and Akua Kuenyehia is Professor of the
Faculty of Law at the University of Ghana and Vice President of the

INTRODUCTION: This disturbing work is based on first-hand field
investigations carried out in the brassware, gem polishing, lock making, and
glass factories. Utilizing data collected under adverse and even hostile
conditions, in defiance of Mafia-like organizations that shield industries
exploiting child labor from the gaze of the outside world, the author
describes the working conditions of these children. A large number of
children, some only five years old, work through the night under great health
and safety hazards. Workplace trauma is widespread, stunting the growth of
these children both physically and mentally. The author contends that these
appalling practices are rampant in India, and that state policies aimed at
protecting children are poorly conceived and badly enforced. Illustrated with
photographs, this thoroughly-documented study provides hard evidence of
widespread abuse and exploitation.

INTRODUCTION: Millions of people are today forced to flee their homes as a
result of conflict, systematic discrimination, or other forms of persecution.
The core instruments on which they must rely to secure international
protection are the 1951 Convention Relating to the Status of Refugees and its

INTRODUCTION: Whether child pornography when it is solely self-created and
privately held serves to consolidate private thought, or has some other
expressive aspect, is irrelevant to the freedom of expression issue on the
view presented in this article. Children are after all a class of persons whom
all parties concede also have the constitutional right to privacy, liberty and
freedom of expression. Children's Charter privacy and liberty rights are
violated when they are used in the production of child pornography. Their
freedom of expression and liberty are further infringed when their position in
society and power is undermined by the existence of child pornography that
degrades their humanity, defines them as sexual objects and denies their
personhood. The child or adolescent cannot provide informed consent for their
participation in the creation of child pornography given the power
differential. It is quite striking that in the Canadian Criminal Code a sexual
activity involving a child, when it involves an adult in a position of trust
or authority, may be considered unlawful, while the same activity is
considered lawful if the adult is not in such a position. It is here argued
that all adults are in reality, if not in law, in a position of trust and
authority in regards children and adolescents. This is in part due to the fact
that young people are highly vulnerable to sexual exploitation by adults
regardless the role that the adult fulfills or the specific age of the child
or adolescent.

INTRODUCTION: This article examines the way in which the international
labour law deals with working children. The claim for the recognition of
children's right to work in dignity is common to several organisations of
working children. They consider working in dignity as a basic human right. On
the international institutional level, the International Labour Organisation
is one of the major players dealing with child labour. The debate on working
children and child labour comprises many references to the importance of law
for improving the living conditions of working children. Actors in the child
labour debate, such as organisations of working children, frequently use to
international human rights law as a basic legal reference. In contemporary
societies two distinctive features are generally emphasised as the core and
most valuable functions of work. On the one hand, work is considered the most
important means to ensure the material existence of a person. By his or her
work and the income it generates, the worker is enabled to fulfill material
needs. On the other hand, work also plays a fundamental role both in the
shaping of one's identity and in his or her interaction with other people. The
worker's social involvement by performing useful work is instrumental for
gaining social recognition

”överkriminalisering”. Denna avhandling behandlar kriminalisering, med tonvikt

straffrättsligt skydd, tekniker för utformning av straffbud, samt synen på vem

kriminaliseringsanvändningen kan sägas följa ur samhällsfördrags- och

A significant minority of children in
Europe, between 10% and 20% as an informed scientific estimate, will be
sexually assaulted during their childhood. This problem has been recognised by
child care professionals, policy makers and increasingly the public at large.
Debates continue about what can be done: how best to intervene, build
confidence in the child protection services (CPS), which responses work and
what to do about the perpetrators.
Child sexual abuse can take many
forms including incest, prostitution, pornography, date rape, peer sexual
violence and institutional sexual abuse: the sexual abuse of children by
people who provide or live in substitute, educational or social care. All
forms of child sexual abuse are linked because they involve children in sexual
activity but to use the term child sexual abuse to cover all forms of sexual
violence can lead to confusion as these activities are different in many ways,
each requiring their own context relevant solutions. Awareness and
understanding of the problem varies from country to country. In some European
countries awareness of child sexual abuse has inevitably to be seen against a
backdrop of transition, major socio-economic difficulties, organised conflict
and individual trauma that has eclipsed all but day to day survival. Child
care professionals were beginning to develop awareness of sexual abuse in many
of these countries in the late 80's and early 90's but their struggles to get
the problem onto a more public agenda had to wait until a time of greater
stability. In other countries public awareness has continued to grow through
high profile cases involving child abduction, murder and 'paedophiles'
highlighted in the media. These extreme tragedies often detract from the more
mundane, everyday experiences of child sexual abuse perpetrated by carers,
'friends', parents and other people in a position of trust.
Most people
will agree that child sexual abuse is a terrible problem, if they know enough
about it, so what is standing in the way of effective solutions and why does
it not appear to be reducing to any significant extent? These are important
questions for all countries to address, whether they are developing new
responses and initiatives or whether they are reviewing and evaluating
established provision.

INTRODUCTION: During recent decades, levels of global wealth have grown at
an impressive rate but at the same time inequalities in wealth distribution
and the gap between the rich and the poor have also increased significantly.
While some people take the enjoyment of comforts made available by
technological advances for granted and consume goods and services at a rate
unimaginable even just a few decades ago, for the majority of humanity such
developments are unattainable and many persons die of hunger or curable
diseases, do not have shelter, access to education or basic sanitation
facilities. Undoubtedly this raises moral questions, but it is also a
juridical problem. This study attempts to show that at least the 145 States
Parties to the International Covenant on Economic, Social and Cultural Rights
[ICESCR] bear significant obligations with regard to the fulfilment of these
rights.
The present work analyses the work of the main supervisory
mechanism of the ICESCR, the U.N. Committee on Economic, Social and Cultural
Rights and aims to clarify the normative content of the Covenant, particularly
with regard to the obligations imposed by Part II of the Covenant. The book
sets the stage for analysis of Part II of the Covenant by first seeking to
clarify some of the doctrinal confusion in the field, such as the distinction
between civil and political rights on the one hand and economic, social and
cultural rights on the other. It also examines the usefulness of typologies of
State duties under human rights instruments. The study then proceeds to
analyse the content and scope of the obligations under Part II of the
Covenant. Part II of the Covenant is composed of four articles which contain a
general obligation clause; a non-discrimination provision; a limitation on the
enjoyment of the rights by non-nationals; non-discrimination on the basis of
sex; a general limitation clause; and interpretation rules. Understanding of
the scope and content of the provisions of Part II is key for interpretation
of the Covenant as a whole as they have a dynamic relationship with all
substantive rights contained in the Covenant and impose obligations with which
States Parties must comply in regard to each of the substantive rights.
The study is intended to contribute to the promotion of the normative
content of the Covenant, particularly of the provisions of Part II. It is
premised on the understanding that a clearer normative content of the Covenant
would facilitate its implementation at the national level as well as its
supervision under the Statereporting procedure and, possibly, pursuant to a
future Optional Protocol establishing a complaints procedure.

certain rights and makes it possible for the child to assert those rights in
domestic judicial or administrative proceedings. As a regional human rights
instrument, the Charter is expected to place within the African context the
children's rights discourse. In this contribution, the merits and demerits of
the Charter were critically discussed. The contribution that the Charter has
made to the children's rights discourse cannot be ignored. The Charter makes
several provisions that have not been articulated in any human rights
instrument before, apart from making several improvements on the Civil Rights
Commission (CRC). However, the Charter is not without weaknesses. The Charter
has omitted quite a few provisions that would be relevant for the better
promotion and protection of children's rights in Africa. It is noteworthy that
most of the weaknesses in the Charter may be cured by reason of the fact that
all African States parties to the CRC. Thus, to the extent that the CRC
provides better protection, State Parties to the Charter will be bound by the
CRC.

INTRODUCTION: Situations of mass refugee influx represent by their very
size and urgency daunting evidence of human suffering and cruelty.
Consequently, the level and quality of refugee protection in times of crisis
is tested. The choices to be made have to take into due consideration the
prevalent conditions and restraints. They will probably always result in
compromises. The question is whom or what the compromises are about?
The focus in the present volume has been set on a detailed examination of some
legal preconceptions commonly found in situations of mass refugee
in-migration. The author concludes that situations when refugees arrive en
masse do not, as a rule, qualify as a public emergency that threatens the life
of the nation under contemporary international human rights law, and that mass
expulsion of refugees as an emergency measure is prohibited at all times when
this entails the risk of violating rights immune to derogation.
